TERMS & CONDITIONS

GENERAL

Clae is operated by Artplus Creative Ltd, hereon referred to as us/we/. All references to you include you as a prospective student or students and guest is reference to someone you may be booking for. By enrolling yourself or a guest into one of our classes you agree to the following terms. We reserve the right to amend these terms at any time and continued attendance by you or another after such amendments will constitute acceptance of the amended terms by you.

  1. Enrolment
    We run pottery classes for the following age groups: 18+

    Places in our courses are only confirmed upon full and upfront payment of the course fees. Towards the end of each course, you are automatically reminded by email to enrol for the following course. Your or another place in the following term will only be confirmed upon full and upfront payment of the next term’s fees.

    Class sizes are strictly limited to the numbers available via our website, and due to the popularity of our classes we cannot reserve places. Any student who has not been enrolled online while there is availability will be unable to attend the course.

    We reserve the right to refuse admission or cancel the enrolment of any student who uses threatening, unsafe behavior or disrupts other students, as our teachers are not qualified to manage students who are unwilling to participate in the scheduled coursework or cause disruption.

  2. Fees
    Please contact us or visit the relevant course page on our website for current pricing. Payment for course fees is to be made online only via our website, which ensures that your or an others place is immediately confirmed upon payment. Please contact our office for assistance if you experience technical difficulties while enrolling online.

  3. Refunds & Transfers
    Please consider your booking carefully before enrolling as we do not offer credits, refunds or class transfers once payment has been processed.

  4. Classes
    Our multiweek courses are designed to be sequential, so we strongly recommend that students attend every class in order to understand and build on the content taught. Students should arrive in time for their class within and no earlier than 10 minutes of the scheduled start time, and should be packed up no later than 5 minutes after the conclusion of each class.

    Students are not permitted to use mobile phones during class time, and all phones should be switched to silent.

    We do not provide food or snacks during any program; however drinking water is always readily available. Throughout term courses no food is permitted in the studio, covered drinks are acceptable.

    We cannot be held responsible for any changes in work commitments or personal circumstances of parents or students, and we will not issue refunds or transfers for any missed classes.

    Subject to class availability, we will offer a make-up class if you inform us in advance that you or your guest will be unable to attend certain dates, you or your guest is unwell, an unforeseen event occurs, or you or your guest has had to miss a class due to a cancellation by staff.  In the event a class is cancelled by staff, we will inform you as soon as we are able to do so.

  5. Teachers
    We reserve the right to change teachers without notice because of circumstances outside of our control, and we will not issue a refund or transfer if there has been a change in the teacher of a class that you or another is enrolled in. You agree that students are enrolled to undertake the course and there is no guarantee as to who the teacher will be.

  6. Supplies
    Refer to your course description for materials that will be provided by the studio. During the development of your own designs or work you may be required to, or wish to purchase customised materials.  There will be an Eftpos machine and a goods trolley on site to do this.  Please make sure that you arrive 10 mins before class to do this so that you are not disrupting the course content. You will need to bring an apron and a hand towel with you. Please contact our office if you need a materials list emailed to you.

  7. Gift Vouchers
    Gift vouchers are available to purchase online via our website and whilst they are non-refundable, they remain valid for up to twelve months. Please note that purchasing a gift voucher does not guarantee a place in one of our programs.

  8. Photography
    We may take photographs of students participating in class or any artwork they create in class, and publish them on our website and social media pages, or for other advertising and publicity purposes. If you do not want to be photographed, we ask that you inform us before the commencement of the course. Nevertheless, if at any time you request that we remove any images of you we will endeavor to do so as soon as possible.

  9. Personal Property
    We cannot be held responsible for any personal property you bring onto the premises, and we cannot be liable for any loss or damage to such property. For this reason, we recommend that students do not bring any valuables to class.

  10. Lost or damaged artwork
    We cannot be held responsible for any lost or damaged pottery belonging to students. It is the responsibility of each student to collect their pottery once it has been processed and the student has been contacted for pick up, as any uncollected pottery may be removed or disposed of.  You will be contacted when your work is ready for collection, please make sure that your contact details are correct.

  11. Health & Safety
    Trained staff will provide basic first aid to the best of their ability in the event of a medical emergency. Ceramics has many chemical hazards so breathing impaired or pregnant women should use masks and gloves, where advised by your tutor. Long hair should be tired back and closed toed shoes worn in the studio. Food is not to be ingested in the studio space and any drinks need a closed lid.  This is an alcohol free space due to the use of equipment.

  12. Feedback
    If you have any concerns or comments, please let us know via the “contact us” section on our website, and we will respond as soon as possible.

  13. Severability
    If any part of these terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

  14. Entire agreement
    Upon payment of our fees, these terms, as amended from time to time, shall represent the entirety of the agreement between you and us, and any changes must be in writing and agreed to by us to have effect.

  15. Covid 19 Response
    In the event of a lock down the following applies:  All government recommendations and restrictions will be adhered to.  Classes will be rescheduled where possible, delivered using an online platform or made available as a make at home kitset.


PLEASE NOTE THAT WE DO NOT REFUND BOOKINGS UNDER ANY CIRCUMSTANCES SO PLEASE DECIDE CAREFULLY UPON ENROLLMENT DURING THESE TIMES.

ORDER - PAYMENT & COLLECTION

  • You can purchase your items online and pick them up at our store, 27 Essex Street, Phillipstown, Christchurch.

  • Orders are processed and shipped once funds are cleared in our bank account for bank payments. Payments can also be made in store. For payments using credit and debit card, a transaction fee of 3.75% is applied

  • If you wish to collect in-store we will keep your order for several days so you can come and collect it at a suitable time. See our opening hrs for collection. Please email us if you are collecting later than 3 days from purchase.

  • Prices are in NZD and all transactions will be charged in NZD. 

  • At the Secure Checkout page, you'll see the ordered item’s description and price.  Your item should be paid for prior to pick up and the payment reconciled.

  • We endeavour to have items in stock but during busy times there may be delays.  You will be advised an ETA if this is the cas for your item.  

  • All items created in this studio are handmade in a small studio practice by artisans.  Your item may therefore have slight variation as this is to be expected. 

ORDER - PAYMENT & SHIPPING

  • Orders are processed and shipped once funds are cleared in our bank account for bank payments. Payments can also be made in store. For payments using credit and debit card, a transaction fee of 3.75% is applied.

  • For items that you wish to be shipped at the Secure Checkout page you will see the ordered item’s description, the price and delivery time. We will email you your tracking number using your designated email address. Delivery times vary depending on your selected delivery address, availability of your items, and the time of the day you place your order. **For shipping in the south island, please send us an email for items 13kgs and above.

  • Rural and heavy goods orders may take up to 1-2 days longer.

  • All orders must be signed upon arrival.

  • We do not ship to PO Box addresses.

  • Items must be double checked before signing your delivery in case items are damaged during transit. Please send us an email (info@.co.nz) within 24 hours if items are damaged. Please include photos of the damaged items as an attachment.

  • We use Peter Baker Transport as our shipping provider. 

  • We currently only ship within New Zealand, if you wish to have your items shipped internationally please email us at info@clae.nz to see if it is possible.

PRIVACY POLICY

Our Privacy Policy follows the obligations in line with the Privacy Act 2020 (‘ Privacy Act ’). This policy also takes into consideration requirements under the General

Data Protection Regulation (GDPR) as it applies to European Union (EU) residents who interact with us, as well as requirements under the California Consumer Privacy Act (CCPA). Where the terms ‘information’ or ‘personal information’ are used in this policy this is a reference to both ‘personal information’ as defined in the Privacy Act and to ‘personal data’ for the purposes of the GDPR (if applicable).

Clae values our customers and respects your privacy. We collect information about you through our website in an effort to improve your shopping experience, as well as communicate with you about our products, services and promotions. We do not sell or rent your personal information to third parties. As described in this policy, we may under certain circumstances share your information among third parties that provide services on our behalf or with whom we have partnered to offer a particular product or service.

This privacy policy applies only to information collected online by Clae and describes the personal information we collect about you, why we collect it, how we use it and when we share it with third parties. If our information practices change, we will post an updated policy on our website.

RETURN POLICY

When returning Clae online products we will offer a credit or exchange on most items purchased at Clae Christchurch, www.clae.nz online.  The items should be returned to us undamaged/as new in order to qualify for this.


If there is a fault with your product, return it to us for a credit / and or exchange.  

Items ordered from Clae should be returned to our store. You will need your tax invoice (email receipt) as information on this is needed as proof of purchase. For credit/exchange, delivery fee is non-refundable.

If the item is faulty, contact the Customer Service Centre at info@clae.nz. If you are unable to go to our store, we will pick up the item for you at an additional pickup cost.

If the item is damaged or incorrect, we will resend the correct item to you as soon as we can.

If you wish to return an item because you have changed your mind about your purchase, Clae can offer you an exchange or credit voucher provided that:


  • You return the item within 7 days of purchase;

  • You produce your original Clae register receipt at the time you return the item

  • The item is in resaleable condition including that:

    • It is in its original packaging, including instruction manuals and all accessories;

    • It is unworn, unopened, unused and in its original condition;

    • Any sew-in labels are still attached; and

    • In the case of electrical equipment the original security seal or shrink wrap is intact and that:

  • The product is not one on which a change of mind return is not available (see below).

If these requirements are not satisfied Clae reserves the right not to offer an exchange voucher or credit for change of mind returns.


Goods on which a change of mind return is not available.

Clae will not accept the return of items from the following categories under the change of mind returns policy under any circumstances:

  • Clay

  • Wheels

  • Kilns

  • Glazes

  • Tools

These products can still be returned if they are faulty, not fit for purpose or do not match the sample or description.

Clae will accept product returns and provide you with an exchange, credit or repair where:

  • The product is faulty or is not of merchantable quality, or

  • The product is not fit for its intended purpose, or

  • The product does not match the sample or our description; and

You can present your Clae register receipt or other adequate proof of purchase.

Please note, in the case of electrical and electronic products (see definition below), Clae may elect to return the product to the manufacturer’s repair agent to determine the nature of the problem. If the product is determined to be faulty, not of merchantable quality, not fit for purpose or not matching a description or sample Clae will offer a repair, exchange voucher or refund.

If you cannot present your Clae receipt or other acceptable proof of purchase Clae the right not to offer a credit or exchange.

In the case of electrical and electronic products Clae will be happy to refer you to the manufacturer’s customer service hotline for assistance with operating difficulties or product repairs.

If you are experiencing operating difficulties with electrical, electronic or other similar products we recommend you first contact the manufacturer’s customer hotline before returning the product. Many operating difficulties can be quickly solved with the right advice.

Clae reserves the right to:

Assess the condition and age of returned goods prior to offering a repair, exchange or refund. This may result in a repair, exchange or refund being refused.

Where you seek a refund for any item that was purchased as part of a ‘deal’, Clae credit/voucher the price in accordance with deal eligibility. No credit/voucher will be given on free items and any credit/voucher amount may be recalculated if your return results in deal eligibility no longer being met.

TERMS OF WEBSITE USE

Artplus Creative “Clae” owns and operates this website. By using or accessing this website you acknowledge that you have read, understood and agreed to be bound by these terms and conditions (“Terms of Use”). If you do not agree to the Terms of Use, please do not use this website.
Ownership of Website and Content
Clae owns the website and, unless otherwise indicated, owns or is licensed to use all content and other material appearing on the website. The material on this website is protected by copyright under the laws of New Zealand and may not be used without written permission by Clae. No trademark (whether registered or not) that is displayed on this website may be used in any way without the prior written permission of Clae or of the relevant trade mark owner.
Any communication or opinions offered on or to this website may not be of a derogatory nature, intended to offend or be in breach of any discrimination outlined in The Human Rights Act.  We would naturally wish to resolve any issue that you have off-line so please email us.
